If you do not wish to be bound by these Terms and Conditions, you may not access or use this Service. If You utilize the service in a manner inconsistent with these Terms and Conditions, "EYE TECH LK" may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse. Eye Tech LK may modify the Terms and Conditions at any time, and such modification shall be effective immediately upon posting of the modified Terms and Conditions. You agree to review the Terms and Conditions periodically to be aware of such modifications and your continued access or use of the Service shall be deemed your conclusive acceptance of the modified Terms and Conditions.

PRIVACY POLICY

We, Eye Tech LK, collect and process the following data about you,

• Information you give us when you purchase our products. This is the information you give us by filling the details in the purchase section to use our products, or by corresponding with us (for example, by email) and when you report a problem using the product. If you contact us, we will keep a record of that correspondence. The information you give us may include your full name, email address, user device platform (Personal Data).
• Each time you use the product, the software automatically collects some technical information, including the operating system type and status. (Device Information) and the product licensing details.

We do not use your Personal Data, Device Information and Log Information to send you push notifications, monitor the App functionality. We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined. We do not store any image that you insert/load to the product when using it or store any information regarding the images you are using, or any detail extracted from the images itself. All the images that are depicted in the User Manuals (or such material) are used under the authorities of their respective owners and cannot be used for any other use without informing the Eye Tech LK.

We may also use your personal information to enforce our End User License Agreement such as, Protect the rights, property or safety of our customers and others.

What happens if I refuse to provide my personal information?

If you do not submit personal information when asked by Eye Tech LK, your refusal may limit our ability to process your online product registration, account creation, purchase via our online website, or request for technical support.

Where we store your personal data

The data we collect from you will be only the information you are providing to us. All the information you provide is stored on our private secure servers. By submitting your personal data, you agree to this storing and processing. We will take all steps necessary to ensure that your data is treated securely and in accordance with this privacy policy. Your name, email address, address, phone number, photo (if any) and country will also be stored on your local storage.

Any payment transactions for the product will not involve any collection of information from us. The relevant Application stores will collect and process this information.

The license key we are providing in order to use will be valid only to one single device and is eligible to request once again if there is any major hardware change occurred within the device you are using. Maximum number of requests per purchase will differ for each price plan that is available to purchase. You are responsible for keeping this/these license key/s confidential. We ask that you not to share this with anyone.

Even though, the transmission of information via the internet is not completely secure, we will do our best to protect your personal data when it is been transmitted. Therefore, any transmission request submitting is at your own risk. We are not responsible for any Man-In-the-Middle attacks (or such attacks) that are happening at your end. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Our product may contain links to websites including, but not limited to, websites on which the product is advertised. If you follow a link to any websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. All other trademarks not owned by Eye Tech LK or its Partners or its vendors that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Eye Tech LK.

All content included on this Site, such as text, graphics, logos, images, digital downloads, data compilations, and software, is the exclusive property of Eye Tech LK, and such content is protected under the Intellectual Property Act of Sri Lanka No 36 of 2003.

LICENSE AND SITE ACCESS

Subject to your compliance with these Conditions of Use and your payment of any applicable fees, Eye Tech LK grant you a limited, non-exclusive, non-transferable, non-sub-licensable license to access and make personal and/or commercial use of Eye Tech LK services. You may print and download (page caching) or portions of material from the different areas of the Service solely for your own use. This license does not include any resale of any Eye Tech Service, or its contents such as,

• any collection and use of any product listings, descriptions, or prices
• any derivative use of any Eye Tech LK Service or its contents
• any downloading or copying of account information for the benefit of another merchant

No Eye Tech LK Service, nor any part of any eyetechnologieslk.com Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Eye Tech LK. You may not misuse the Eye Tech LK Services. The licenses granted by Eye Tech LK terminate if you do not comply with these Terms and Conditions of Use.

YOUR ACCOUNT

If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. Furthermore, you are responsible for any and all activities that occur under your account or Purchase ID. You authorize Eye Tech LK to assume that any person using the Site with your Purchase ID and email either is you or is authorized to act for you. You agree to notify Eye Tech LK immediately of any unauthorized use of your account or any other breach of security. Eye Tech LK will not be liable for any loss that you may incur as a result of someone else using your Purchase ID or account either with or without your knowledge. However, you could be held liable for losses incurred by Eye Tech LK or another party due to someone else using your account or Purchase ID. Eye Tech LK does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under the age of 18, you may use eyetechnologieslk.com only with involvement of a parent or guardian.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

This Site and all information, content, materials, products and services included on or otherwise made available to you through this Site are provided by Eye Tech LK, unless otherwise specified in writing. Eye Tech LK warrant that this Site; information, content, materials, products or services included on or otherwise made available to you through this Site; their servers; or e-mail sent from the Site are free of viruses, or free from other harmful components. Eye Tech LK will not be liable for any damages of any kind arising from third parties who are referring the site or from any information, content, materials, products or services included on or otherwise made available to you through a referral link or a separate download link, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

DISPUTES

You agree that any legal action, dispute or proceeding between Eye Tech LK and you for any purpose concerning the Terms and Conditions or in relation to your visit to the Site or the products you purchase through the Site or the parties’ obligation hereunder shall be governed by the Arbitration Act No 11 of 1995 in Sri Lanka. Any cause of action or claim you may have with respect to the Services must be commenced within one (01) year after the claim or cause of action arises or such claim or cause of action is barred.
