END USER LICENSE AGREEMENT

1. DEFINITIONS. When used in this Agreement, the following terms shall have the respective meanings indicated, such meanings to be applicable to both the singular and plural forms of the terms defined;

   • Licensor: means Eye Tech LK company. "Licensee" means You or Your Company, unless otherwise indicated.
   • Software: means all of the contents of the files, or other media with which this Agreement is provided.
   • Use/Using: means to access, install, download, copy, or otherwise benefit from using the functionality of the Software, said above.
   • Device: means an electronic device that accepts information in digital or similar form and manipulates it for a specific result based on a sequence of instructions.

2. GENERAL TERMS. Complying with all applicable copyright laws is the responsibility of the user. Without limiting the rights under copyright, no part of this program may be reproduced, stored in or introduced into a retrieval system, or transmitted in any form or by any means (electronic, mechanical, recording, or otherwise), or for any purpose, without the express written permission of Eye Tech LK.

   Eye Tech LK may have patents, patent applications, trademarks, copyrights, or other intellectual property rights covering subject matter in this software. Except as expressly provided in any written license agreement from Eye Tech LK, our provision of the software does not give you any license to these patents, trademarks, copyrights, or other intellectual property.

   1. TRIAL EDITION USE RIGHTS. If the software is a trial edition, then this Section applies to your use of the trial edition along with the rest of the terms.
      1. GENERAL. You can only use a single copy of the trial edition on your device. You may only use the trial edition for internal evaluation purposes, and only during the trial period.
      2. TRIAL PERIOD AND CONVERSION. The length of the trial period is the first fifteen (15) days after you install the trial edition. After the expiration of the trial period, the trial edition will stop running. You may not be able to access data used with the trial edition when it stops running. You may convert your trial rights at any time to the full-use rights by acquiring a valid full-use license.
      3. RESTRICTIONS. The software can only be used in a device with a stable internet connection along with the other system requirements. The features such as managing users and print reports will not be available under the trial edition.
      4. SUPPORT. We may not provide any support services for the trial edition.
   2. FULL-USE LICENSE TERMS. When you acquire a valid license and either enter a product key or sign in to the software, the full-use terms below apply.
      1. GENERAL. The software includes applications and documentation. You can only use a single product key on a single device at any given time.
      2. LICENSE MODEL. The software is licensed on a per user basis. You may not share your product key or access credentials. Once activated the product key will be hardware bind to the device which was activated. If there is any critical hardware change within this device you can request a new activation, up to a maximum of 3 times. The number of requests will be according to the type of the license you have acquired.

3. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to use the software. Eye Tech LK reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not;

   • workaround any technical limitations in the software.
   • reverse engineer, decompile or disassemble the software, or otherwise attempt to derive the source code for the software.
   • remove, minimize, block or modify any notices of Eye Tech LK or its suppliers in the software.
   • use the software in any way that is against the law.
   • share, publish, rent or lease the software, or provide the software as a stand-alone hosted solution for others to use.

4. DOCUMENTATION. Any person that has valid access to your computer or internal network may copy and use the documentation for your internal, reference purposes. You may not copy the documentation (User Manual or other documentation) except as expressly permitted above. All the images that are depicted in the documentation are used under the authorities of their respective owners and cannot be used for any other use without informing Eye Tech LK.

5. TRANSFER TO A THIRD PARTY. If you are a valid licensee of the Eye Test KFR software, you may transfer it and this license agreement directly to another party. Before the transfer, that party must agree that this agreement applies to the transfer and use of the software. The transfer must include the software, genuine product key, and (if applicable) the Proof of License label. The transferor must uninstall all copies of the software after transferring it from the device. The transferor may not retain any copies of the genuine product key to be transferred, and may only retain copies of the software if otherwise licensed to do so. If you have acquired a non-perpetual license to use the software or if the software is marked Not for Resale (NFR) you may not transfer the software or the software license agreement to another party.

6. PRIVACY POLICY. We, Eye Tech LK, collect and process the following data about you;

   • Information you give us when you register to use this product. This is information you give us by registering to use our product, or by corresponding with us (for example, by email) and when you report a problem with the product. If you contact us, we will keep a record of that correspondence. The information you give us may include your full name, email address, user device platform (Personal Data).
   • Each time you use the product, the software automatically collects some technical information, including the operating system type and status. (Device Information) and product licensing details.
   
   

   We do not use your Personal Data, Device Information and Log Information to send you push-notifications, monitor the App functionality. We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined. We do not store any image that you insert/load to the product when using it or store any information regarding the images you are using, or any detail extracted from the images itself.

   We may also use your personal information to enforce our End User License Agreement such as, Protect the rights, property or safety of our customers and others.

   1. WHERE WE STORE YOUR DATA. The data we collect from you will be only the information you are providing to us. All the information you provide is stored on our private secure servers. By submitting your personal data, you agree to this storing and processing. We will take all steps necessary to ensure that your data is treated securely and in accordance with this privacy policy. Your name, email address, address, phone number, photo (if any), and country will also be stored on your local storage.
      
      Any payment transactions for the product(s) will not involve any collection of information from us. The relevant Application stores will collect and process this information.    2. INFORMATION SECURITY. The license key we are providing in order to use will be valid only to one single device and is eligible to request once again if there is any major hardware change occurred within the device you are using. you are responsible for keeping this license key confidential. We ask that you not to share this with anyone.
      
      Even though the transmission of information via the internet is not completely secure, we will do our best to protect your personal data when it is been transmitted. Therefore, any transmission request submitting is at your own risk. We are not responsible for any Man-In-the-Middle attacks (or such attacks) that are happening at your end. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
      
      Our product may contain links to websites including, but not limited to, websites on which the product is advertised. If you follow a link to any websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.
   3. YOUR RIGHTS TO ACCESS THE INFORMATION. Complying to the Data Protection Act you can access your name, address and any other information held about you by contacting: [email protected]

7. DISCLAIMERS. Eye Tech LK, disclaims all warranties as to this program’s merchantability or fitness for a particular purpose. In no event shall Eye Tech LK be liable to any damage or loss of profits in connection with the use of this software.

8. TRADEMARK INFORMATION. The trademarks, logos and other marks displayed on this Web site are the property of Eye Tech LK, its licensors, and/or other third parties. You are not permitted to use marks without the prior written consent of Eye Tech LK or such third party which may own marks.

9. THIRD-PARTY INFORMATION. The descriptions of other companies’ products in this software, if any, are provided only as a convenience to you. Any such references should not be considered an endorsement or support by Eye Tech LK. Eye Tech LK cannot guarantee their accuracy, and the products may change over time. Also, the descriptions are intended as brief highlights to aid understanding, rather than as thorough coverage. For authoritative descriptions of these products, please consult their respective manufacturers.

   1. LINKS TO THIRD-PARTY WEB SITES. The Eye Test KFR software contains links to third-party Web sites, which are not under the control of Eye Tech LK. 10. GENERAL PROVISION. This is the entire agreement between you and Eye Tech LK, which supersedes any prior agreement or understanding, whether written, or oral, relating to the subject matter of this EULA. If any part of this EULA is found void and unenforceable, it will not affect the validity of the balance of the agreement, which shall remain valid and enforceable according to its terms. This EULA shall automatically terminate upon failure by you to comply with its terms. Eye Tech LK, on its sole discretion, may modify this EULA in writing at any time.
11. CHANGES TO THE PRIVACY POLICY AND EULA. Any changes we may make to our End User License Agreement in the future will be posted on the official page. https://eyetechlk.pahinv.com/license/
